A TPA using The Phia Group’s subrogation services realized nearly an 85% recovery in an incredibly challenging case involving an alleged medical malpractice matter and a difficult lien resolution group. In the underlying matter, the member suffered a stroke during a routine surgery. The member alleged the treating physicians and staff failed to properly identify the member’s medical event, leaving the member permanently nonverbal and unable to walk unassisted.

The member’s underlying claim was extremely complex due to the member’s pre-existing medical conditions and heavily disputed liability. The member’s attorney retained a lien resolution company to combat the Plan’s reimbursement interest in its entirety.

The Phia Group upheld the self-funded Plan’s strong right of recovery by deploying a multi-faceted defense of the Plan’s reimbursement interest. This approach, including extensive document reviews and requests made by The Phia Group to the lien resolution company, turned the tables and ultimately The Phia Group secured nearly the entirety of the Plan’s reimbursement interest. The Phia Group also coordinated with the Plan’s stop-loss carrier, ensuring the Plan’s compliance with its stop-loss policy while reaching an amicable resolution for all interested parties.

By partnering with The Phia Group, the client saved $950,000.00 after the Plan advanced benefits exceeding $1,000,000.00, ensuring the Plan’s viability and compliance with their stop-loss obligations.
